Appeal Court judgment on election petition not final – Falana
Femi Falana, a Senior Advocate of Nigeria, has stated that the judgment of the presidential election petition tribunal is not final. He added that aggrieved parties will have the opportunity to appeal at the Supreme Court.
He stated that such behavior is unnecessary, as there is still an opportunity to appeal to the Supreme Court. Falana also noted that no election petition has attracted such attention since colonial rule.
“We have been having election petitions since the colonial era, but none has attracted such level of blackmail and intimidation of the judiciary.
“I am worried that people give the impression that everything ends with the judgement of the Court of Appeal, the Presidential Election Petition Tribunal. Any party that loses on Wednesday still has the opportunity to appeal to the Supreme Court. So, what is the basis for the cheap blackmail that is going on?” Falana said on Channels Television’s Politics Today on Monday
The senior advocate attributed the blackmail and intimidation to new voters who believe their candidate must be declared the winner.
However, he emphasized that it is the role of the justices to examine the evidence, apply the law, and deliver a decision without being intimidated by blackmail or threats.
The tribunal has confirmed that it will deliver its judgment on the presidential election petitions on Wednesday, with live broadcast available for interested television stations.
The Labour Party, the Peoples Democratic Party, and the Allied Peoples Movement, along with their presidential candidates, have petitioned the tribunal seeking to nullify the election of President Bola Tinubu as the winner of the 2023 presidential election.
