KWAM 1 withdraws suit challenging Awujale selection process

The Vice Chairman of the Fusengbuwa Ruling House of Ijebu Ode and counsel to the family, Prof. Fassy Yusuf, has confirmed that popular Fuji musician, Alhaji Wasiu Ayinde, also known as KWAM 1, has withdrawn the suit he instituted against the Ogun State Government and the ruling house over the selection process of the next Awujale of Ijebuland.

Ayinde was said to have filed a notice of discontinuance dated December 22 before the Ogun State High Court sitting in Ijebu Ode, informing the court of his decision not to pursue the matter further and urging that the suit be discontinued.

Speaking with a correspondent on Wednesday, Prof. Yusuf confirmed that the notice of discontinuance was filed on Monday, shortly after the court declined to grant Ayinde’s application for an interim injunction seeking to restrain Governor Dapo Abiodun, the Fusengbuwa ruling house, and others from taking further steps in the selection process.

“I can confirm that Wasiu Ayinde has filed a notice of discontinuance of the suit instituted against Gov Dapo Abiodun, the Fusengbuwa ruling house, the Awujale Interregnum Administration Committee, the Chairman of Ijebu Ode Local Government and others.

“On Monday, his exparte motion came up for hearing, but unfortunately, the presiding judge, Justice A A Omoniyi, declined to grant the order of interim injunction seeking to stop the selection process of the Awujale.

“Maybe after due consultation with his legal counsel, he decided to withdraw the suit, having suffered defeat when the case came up for hearing on Monday and decided to file a withdrawal of the suit; nobody knows.

“The truth, however, is that the Fuji musician has filed for the discontinuance of his suit against the government and our family, and this application would be formally heard on January 14, which is the next adjournment day for the suit.”

Ayinde had earlier expressed interest in the vacant Awujale stool, claiming lineage from the Jadiara Royal House within the larger Fusengbuwa Ruling House. However, the Fusengbuwa ruling house, which is responsible for producing the next Awujale, rejected his claim, insisting that the musician does not belong to the royal lineage.

The Fuji artiste is widely believed to hail from the Fidipote ruling house of Ijebu Ode, a claim he has frequently referenced in his music.

In response to what he described as injustice, Ayinde had dragged the Fusengbuwa ruling house, Governor Abiodun, the Chairman of Ijebu Ode Local Government, Dare Alebiosu, and three others before the court, seeking an interim injunction to halt the selection and installation process of the next Awujale of Ijebuland.

Other defendants listed in the suit include the Commissioner for Local Government and Chieftaincy Affairs, Ganiyu Hamzat; the Secretary of Ijebu-Ode Local Government, Oke Adebanjo; and the Chairman of the Awujale Interregnum Administrative Council, Dr. Olorogun Sunny Kuku.

The suit, numbered HC3/238/2025, was contained in a court document dated December 16, 2025, which later circulated widely.

In his application, Ayinde stated that the motion exparte was brought pursuant to Order 38 Rule 4 and Order 39 Rule 1 of the Ogun State High Court (Civil Procedure) Rules 2024, Section 36 of the 1999 Constitution (as amended), and under the inherent jurisdiction of the court.

He urged the court to restrain the respondents from taking further steps in the selection process pending the determination of the substantive suit and asked that an interim injunction be granted to preserve his interest.

However, in his ruling delivered on Monday, Justice A. A. Omoniyi held that the application for interim injunction lacked merit and that no sufficient grounds had been placed before the court to justify granting the order.

The judge subsequently ordered an accelerated hearing of the substantive matter and fixed January 14, 2026, for further proceedings.
