Court martial convicts Maj-Gen of $1.47m fraud

A Special Court Martial established by the Nigerian Army has declared Major General Umar Mohammed, the former Group Managing Director and Executive Vice Chairman of Nigerian Army Properties Limited, guilty on 14 out of 18 counts, including theft, forgery, conspiracy, and other service law violations.

The charges brought against General Mohammed encompassed offenses such as stealing, forgery, conspiracy, theft, and unauthorized diversion of Army property, among others.

One of the charges on which he was found guilty relates to the receipt of $1.045,400 from shipping companies for the use of the Nigerian Army Jetty located at 6 Marina, Victoria Island, Lagos.

Additionally, he was found guilty of stealing $430,800, which was monies deposited into the Nigerian Army Domiciliary account at Unity Bank, Abuja, for the use of the Nigerian Army Jetty in Marina, Lagos.

The court martial also found General Mohammed guilty of withdrawing and misappropriating N74 million out of N75 million paid for a property owned by the Nigerian Army in Ikoyi, Lagos.

However, he was acquitted of allegations that he sold Army property worth N200 million in Lagos and stole N750 million out of the N2.5 billion secured from banks and contributions from subscribers for an Army housing estate in Asokoro, Abuja.

The charges of forging a Deed of Agreement document to seize another Army property in Lagos were also dismissed.

The Special Court Martial, with Major General Kames Myam as President, consists of seven other Major Generals as members and a Brigadier General as Judge Advocate. Sentences for the accused are expected to be announced next Tuesday.

During the court-martial, Major General Umar Mohammed was brought into court in a wheelchair.

Still, the President of the court, Maj-Gen Myan, affirmed that all necessary medical assessments confirmed the accused was fit to stand trial.

The prosecution was led by Col BA Oguntayo (Rtd), while Olalekan Ojo, SAN, served as the lead counsel for the defense.

The court is set to deliver judgment in the case on October 10, 2023.
