US court disqualifies Trump from running for president
Colorado’s Supreme Court has declared that former United States President, Donald Trump is ineligible to run for the White House.
The decision is rooted in Trump’s involvement in the 2021 assault on the Capitol by his supporters, invoking Section 3 of the 14th Amendment, which disqualifies individuals who have “engaged in insurrection” from holding public office.
The majority decision, written by the Colorado high court in a four-three ruling, stated, “A majority of the court holds that President Trump is disqualified from holding the office of President under Section Three of the Fourteenth Amendment to the United States Constitution. Because he is disqualified, it would be a wrongful act under the Election Code for the Colorado Secretary of State to list him as a candidate on the presidential primary ballot. We do not reach these conclusions lightly.”
This decision is the first time Section 3 of the 14th Amendment has been used to disqualify a presidential candidate.
The ruling only applies to Colorado but sets a precedent as other states consider similar actions.
Noah Bookbinder from the Citizens for Responsibility and Ethics in Washington, a group involved in the case, welcomed the decision, stating, “Our Constitution clearly states that those who violate their oath by attacking our democracy are barred from serving in government.”
The court’s decision is on hold until January 4 or until the U.S. Supreme Court rules on the case.
The matter must be settled by January 5, the deadline for the state to print its presidential primary ballots.
Trump’s campaign plans to appeal the decision, with spokesperson Steven Cheung stating, “We would swiftly file an appeal” to the U.S. Supreme Court.
Cheung criticized the Colorado court, accusing it of being influenced by a left-wing group and engaging in interference in favor of President Joe Biden.
The ruling comes amidst numerous legal challenges faced by Trump, including criminal charges related to the 2020 election, mishandling classified documents, hush money payments, and business fraud.
