The Supreme Court of Nigeria on Thursday, October 26, 2023, dismissed the appeal filed by Atiku Abubakar, the presidential candidate of the Peoples Democratic Party against the election of President Bola Tinubu.
A seven-member panel of the Supreme Court, led by Justice John Okoro, unanimously held that Atiku’s appeal lacked merit and dismissed it accordingly.
The court also affirmed the judgment of the Presidential Election Petition Tribunal, which had on September 6, 2023, affirmed Tinubu’s election as president.
Justice Okoro, in the lead judgment, said that the Supreme Court had resolved all seven issues raised by Atiku for determination in favour of the respondents.
“On the whole, there is no merit in this appeal, and it is hereby dismissed.
“The judgment of the court below is hereby affirmed,” Okoro held.
The court also declined to accept fresh evidence from Atiku to prove that Tinubu forged the certificate he submitted to the Independent National Electoral Commission in aid of his qualification for the 2023 presidential election.
