A Federal High Court in Abuja declared the emergence of Andy Uba as the All Progressives Congress flagbearer in the recent governorship election in Anambra State as illegal.
This comes after Justice Iyang Ekwo voided the party's primary poll and Uba's participation in the November 6 governorship election was void.
The PUNCH reports that the judge concluded that Uba was never a candidate in the election having emerged from an illegally conducted primary election.
Although Uba emerged the winner during the party's primary poll, Justice Ekwo noted that the plaintiff, George Moghalu, proved beyond doubt in proving that the APC conducted an invalid primary.
Following the judgement, Justice Ekwo ordered the Independent National Electoral Commission to delete Uba from its record as a candidate in the election.
Since it was concluded that the APC did not conduct a valid primary, the court ordered the party to reimburse Moghalu the sum of N22.5m which is the amount he paid for expression of interest and nomination forms.
Recall that Prof. Chukwuma Soludo of the All Progressive Grand Alliance defeated Uba who had 43,000 votes to win the main election.
