NERC approves transfer of electricity regulation to Kogi

The Nigerian Electricity Regulatory Commission has approved the transfer of oversight for the electricity market in Kogi State to the Kogi State Electricity Regulatory Commission.

This decision aligns with the amended Constitution of the Federal Republic of Nigeria and the Electricity Act of 2023.

In a statement on Wednesday, NERC explained that this move followed legal requirements that allow states to regulate their own electricity markets.

The statement said, “The Government of Kogi State complied with the conditions precedent in the laws, duly notified us and requested for the transfer of regulatory oversight of the intrastate electricity market in Kogi State.”

With this approval, the Abuja Electricity Distribution Company is directed to form a subsidiary, AEDC SubCo, which will manage electricity supply and distribution within Kogi State. NERC added, “The sub-company shall apply for and obtain a licence for the intrastate supply and distribution of electricity from KSERC.”

The process is expected to be completed by March 12, 2025, with AEDC given 60 days, starting from September 13, 2024, to establish the subsidiary.
