Two men jailed two months over motorcycle theft

An Upper Area Court in Gwagwalada, FCT, on Tuesday, sentenced two men to two months imprisonment each for stealing a motorcycle valued N50,000.

Joel Musa, 23, and Usman Musa, 25, who both reside in Gwagwalada area of Abuja were docked for criminal conspiracy, trespass and theft.

The convicts pleaded guilty to the charge and begged for leniency.

The Judge, Sani Umar, ordered the convicts to pay a fine of N20,000 each for each of the three-count or go to a prison term of two months each for each of the count.

”If the convicts fails to pay the fine, they will serve a jail term of two months each for each of the offence, which would run concurrently.

“For count one, they will pay a fine of N20,000 each or serve a jail term of two months each and the same applies to count two and three.

“The reason for this sentence is because the offence had become rampant in the area. Besides, they are first time offenders and have shown remorse for their action,” he ruled.

He said the sentence would serve as a deterrent to anyone that wants to toe that path in future.

He granted the application of the Prosecution Counsel, Abdullahi Tanko that the recovered motorcycle be returned to the owner.

Earlier, Tanko told the court that the complainant, Jonah Onoja of Gwako 2 Village, Gwagwalada, reported the matter at the police station on Feb. 18.

He said that the convicts criminally conspired and trespassed into the complainant’s compound and stole his Jincheng brand motorcycle, valued N50,000.

Tanko said that the convicts were arrested and the said motorcycle recovered.

The prosecutor said that the offence contravened the provisions of sections 96, 342 and 287 of the Penal Code.
