An Upper Area Court seating in Masaka, Nasarawa State, on Thursday, sentenced a 31-year-old commercial driver to two months imprisonment for biting off part of his neighbour’s ear.
The convict, Raymond Danladi, who resides in Angwa Bokolo, Masaka was sentenced by Justice Yakubu Ishaku after pleading guilty to one count charge of causing grievous hurt.
Danladi reportedly attacked his neighbour, Inspector Rabiu Isah, for telling his former girlfriend not to reconcile with him after they broke up.
The judge while delivering the judgment also fined the convict the sum of N5, 000. He directed that the convict should spend additional three months in prison if he fails to pay the fine.
The judge awarded the sum of N30, 000 as compensation for the treatment of the nominal complainant’s bitten ear and the sum of N25, 000 as compensation for the expenses incurred in the prosecution of the case.
Ishaku ordered that the money should be paid within five weeks from the day of the sentence, adding that if the convict defaults to pay the compensation, he should spend additional eight months in jail.
The police prosecutor, Francis Swem, had told the court that Inspector Isah of All Women Jubilation came to the divisional police headquarters and reported that on February 7, 2018 at 11pm, one Rejoice Kiwanza, an ex-girlfriend to the convict, came to him to complain about a scuffle they had and that while he was advising her, the convict attacked him and in the process bit off part of his left ear.
The prosecutor said the offence is punishable under section 247 of the Penal Code.
Dalandi during his plea prayed the court to temper justice with mercy. He said he had been dating the girl for over seven years before they broke up.
The convict said a pastor advised them to settle their differences and be prayerful, but when he got home on the day of the incident he met Isah advising the girl not to reconcile with him.
