A Kwara State High Court sitting in Ilorin on Monday ordered for hearing notice to be served on Sobi FM, a private Radio station in Ilorin, over alleged breach of agreement.
Bil-qayyum Islamic Foundation had earlier filed a complain against Sobi FM over alledged breach of agreement.
Counsel for the complainant, Mr. Hammed Abaya, in his submission told the court that he had personally served the hearing notice on the matter on Sobi FM, which was acknowledged with receipt by the radio station.
Abaya added that the defendant was absent in court and not represented by any counsel.
The counsel later presented a statement of claim to the court on the authenticity of the foundation.
He thereby applied for some time to enable him provide all the certified documents of the foundation and proceed with his evidence.
The presiding judge, Justice Abiodun Adebara granted the application made by the counsel to the claimant, and ordered that a week notice should be served on Sobi FM to justify their absence in court.
The Judge advised the counsel to serve the defendant earlier enough, and also get the necessary documents ready, before the adjourned date.
The court adjourned the case to April 22, for hearing.
The foundation and Sobi FM agreed on a certain term for airing of a paid programme on the radio station.
The station eventually failed to provide the service.
The foundation wrote letters to Sobi FM on different occasions, but the organisation refused to give a tangible reason for not providing the service that was paid for.
