Court sacks LP lawmaker, orders fresh election in Enugu
The Court of Appeal sitting in Lagos State has sacked Denis Agbo, the member-elect for Udenu/Igboeze North federal constituency of Enugu State on the platform of the Labour Party.
The court ordered a fresh election within 90 days following an appeal filed by the All Progressives Congress candidate, Dr Oby Ajih.
Ajih had challenged the ruling of the election tribunal, which had upheld Agbo’s election despite the non-inclusion of the APC logo on the result sheet (Form EC8A).
The Court of Appeal ruled that the non-inclusion of the APC logo violated the Electoral Act and set aside the tribunal’s judgment.
The court ordered the Independent National Electoral Commission to conduct a fresh election for all parties involved.
