11-year-old sues hospital N100m for damaged testis

An 11-year-old boy, Nelson George, has filed a lawsuit against Limi Children’s Hospital Limited, seeking N100 million in damages for alleged misdiagnosis and mistreatment that led to the damage of one of his testes.

The lawsuit was reportedly filed through his father, Bankole George, who also requested an order for the hospital to pay N5 million as the cost of filing the suit.

The suit, marked FCT/HC/CV/7356/2023 and filed on August 28, alleges that Nelson suffered damage to his testes due to the hospital’s misdiagnosis and mistreatment.

Nelson’s lawyer, Emmanuel Ekpenyong of Fred-Young & Evans LP, filed the suit on his behalf.

In addition to the financial damages, Nelson is requesting an order directing the hospital to issue a letter of apology for the alleged misconduct.

Nelson, an 11-year-old Junior Secondary School 3 student, lives under the guardianship of his father, Bankole George.

Bankole George, a Grade Level 18, Step 11 Director of Dangote Cement Plc., is a subscriber to the Platinum package of the National Health Insurance Scheme (NHIS AXA MANSARD), benefiting Nelson as well.

The statement of claim reveals, “On 30th January 2023, Bankole discovered that the claimant (Nelson) was having serious abdominal pains, and his genital and scrotum were swollen. Bankole promptly rushed the claimant to the 1st defendant’s hospital, which is one of the hospitals listed in Bankole’s package of the NHIS for himself and his family members to which the claimant is one. After preliminary checks, the claimant was admitted at the 1st defendant’s hospital for treatment.”

The statement further explains the medical procedures and treatments Nelson underwent, leading to a diagnosis of Testicular Torsion (“TT”) at Nisa Premier Hospital Abuja.

Allegedly, Limi Children’s Hospital Limited’s delay in diagnosis and treatment resulted in the complete damage of one of Nelson’s testes.

Nelson’s lawyer, Ekpenyong, claims that the hospital’s delay in discovering and promptly carrying out surgery on Nelson had led to complete damage to one of his testes.

The defendants are yet to respond to the originating processes.
